Terms of Service
These Terms of Service ("Terms") govern your access to and use of canvyra.com (the "Site") and any products you order from us. By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.
The Site is operated by ("Canvyra", "we", "us", "our") . You can reach us at support@canvyra.com.
1. Who may use the Site
You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order. By ordering you confirm you meet this requirement and that the information you provide is accurate and complete.
You may not use the Site for any unlawful purpose, to breach any law or regulation in your jurisdiction, to infringe anyone's intellectual property or privacy rights, to upload malicious code, or to interfere with the operation or security of the Site.
2. What we sell
Canvyra produces personalized wall art. You upload a photograph, choose an artistic style, and our software generates preview artworks from that photograph. You select one preview, which we then print on canvas, stretch by hand, and ship to you.
Each piece is made to order for you individually. Nothing is held in stock and nothing can be resold or restocked.
3. How your artwork is created
Your artwork is created by our artificial-intelligence painting engine, which reinterprets the photograph you upload in the style you select. The result is a new image generated from your photograph; it is not a hand-painted original, and it is not a photographic reproduction.
Because each photograph and each generation is different, results vary. The brushwork, texture, background treatment and colour palette are the product of the style you selected. Previews are provided free of charge precisely so that you can see the result before you decide to buy.
4. Photographs you upload
Your responsibilities
By uploading a photograph you confirm that:
- you own the photograph, or have the right and permission to use it for this purpose;
- you have the consent of every identifiable person appearing in it;
- the photograph does not infringe any copyright, trademark, publicity right, privacy right or other right of any third party; and
- the photograph does not depict a minor in any inappropriate context, sexual content, nudity, violence, hate symbols, or anything unlawful.
You are solely responsible for the content you upload. You agree to indemnify us against any claim, loss, or expense arising from a photograph you supplied.
What we do with it
You retain all rights in the photograph you upload. You grant us a limited, non-exclusive licence to store, process and modify that photograph solely to generate previews, produce your artwork, and fulfil your order.
We do not sell your photographs, use them to train our systems, or use them in marketing without your separate written permission. Uploaded originals are deleted within 30 days. See our Privacy Policy for full detail.
What we may refuse
We may refuse or cancel any order, and remove any upload, where we reasonably believe it breaches these Terms. Our systems and our production partners also apply their own automated content checks, and some photographs may be rejected automatically. Where an order is cancelled for this reason before production, you receive a full refund.
5. Rights in the finished artwork
The artwork we produce from your photograph is licensed to you for personal, non-commercial use — to display in your home, or to give as a gift.
You may not resell the artwork or the digital file, reproduce it commercially, or use it to create derivative products for sale, without our written permission. We retain rights in our styles, prompts, software, engine and templates.
6. Previews, orders and acceptance
Previews are free and carry a visible watermark. The final print is produced at high resolution without the watermark.
Preview generation is rate-limited per visitor to keep the service available to everyone. We may adjust these limits at any time.
Placing an order is an offer to buy. A contract is formed when we send you an order confirmation. We may decline an order, or cancel it before production, where the item is mispriced, the content breaches these Terms, we cannot verify payment, or we cannot ship to your address; in each case you receive a full refund.
The preview you select at checkout is the artwork we print. Please review it, and your chosen size and orientation, carefully before paying.
7. Prices and payment
Prices are shown in the currency selected on the Site and may change at any time before you order. Prices exclude shipping and any taxes or duties, which are shown at checkout or charged on delivery depending on your destination.
Payment is taken in full at checkout. We use third-party payment processors and do not store your card details.
If an item's price is obviously incorrect through error, we may cancel the order and refund you rather than supply at that price.
8. Collector benefits and promotions
Automatic order-value benefits, discount codes and promotions apply as stated at the time of the offer, cannot be combined unless we say so, have no cash value, and may be withdrawn or changed at any time. Benefits are calculated on the order subtotal before shipping and taxes.
9. Production, shipping and delivery
Production and delivery times shown anywhere on the Site are estimates, not guarantees, and do not form part of our contract with you. Risk of loss passes to you on delivery to the address you supplied.
We are not liable for delays outside our control, including carrier delays, customs and duties processing, weather, industrial action, incorrect addresses, or peak-period volume. Full detail, including lost parcels, is in our Refund & Reprint Policy.
10. Cancellations, reprints and refunds
Personalized items are final sale. Our Refund & Reprint Policy forms part of these Terms and sets out the cancellation window, the reprint process for misprinted items, the process for damaged items, and how claims are assessed. Please read it before ordering.
11. Colour, materials and variation
Screens are backlit and every display is calibrated differently; canvas reflects light rather than emitting it. Slight variation in tone, brightness or saturation between your screen and the printed piece is normal. Small variation in edge margins, wrap position and framing is inherent to made-to-order canvas production.
12. Reviews and content you post
If you submit a review, photograph or other content to us or through the Site, you grant us a non-exclusive, royalty-free licence to use, display and reproduce it in connection with our business. You confirm the content is your own honest opinion and experience. We may remove content that is unlawful, abusive, or misleading.
13. Accuracy of the Site
We work to keep product descriptions, images and pricing accurate, but we do not warrant that content on the Site is error-free, complete or current. Product images and previews are representations; the delivered piece may vary slightly as described in section 11.
14. Third-party services
The Site relies on third parties, including payment processors, print and fulfilment partners, carriers, and AI and hosting providers. Their terms govern their own services. We are not responsible for the content or practices of any third-party website linked from the Site.
15. Availability of the Site
We provide the Site and the preview service "as is" and "as available". We do not warrant uninterrupted or error-free operation, and we may suspend, withdraw or change any part of the Site, including the preview service, at any time.
16. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential losses, loss of profit, or loss of data arising from your use of the Site or any product.
Our total liability in connection with any order is limited to the amount you paid for that order.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or fraud. Nothing in these Terms affects your mandatory statutory rights as a consumer in your country of residence.
17. Indemnity
You agree to indemnify and hold harmless Canvyra, its officers, employees and partners from any claim or demand, including reasonable legal fees, arising from your breach of these Terms or your infringement of any third-party right.
18. Privacy
Our Privacy Policy explains what personal data we collect, how uploaded photographs are handled and retained, and your rights. It forms part of these Terms.
19. Changes to these Terms
We may update these Terms at any time by posting a revised version on this page. The version in force when you place an order is the version that applies to that order. Continued use of the Site after changes are posted constitutes acceptance.
20. Governing law and disputes
These Terms are governed by the laws of Wyoming, without regard to its conflict-of-law rules, and the courts of Wyoming have exclusive jurisdiction, except where mandatory consumer-protection law in your country of residence gives you the right to bring proceedings locally.
Before starting any formal proceedings, please contact us at support@canvyra.com so we can try to resolve the matter directly. Most issues are settled this way.
21. General
If any provision of these Terms is found unenforceable, the remaining provisions continue in full force. Our failure to enforce any right is not a waiver of it. These Terms, together with our Refund & Reprint Policy, Privacy Policy and Shipping Policy, are the entire agreement between us regarding the Site and your orders.
